Defendant shall be punished by a fine of KRW 40,000,000.

The provisional payment of the amount equivalent to the above fine shall be ordered.

Punishment of the crime

Defendant

A company and LSP Co., Ltd. (hereinafter referred to as “ELSP”), EsP, and Esex (hereinafter referred to as “Esex”) are persons who manufacture and sell each mechanical power system, and are business operators under Article 2 subparag. 1 of the Monopoly Regulation and Fair Trade Act.

[Basic Agreement and Relevant Persons] LSP and Esex agreed to participate in the bidding with Korea Electric Cable Co., Ltd., which had obtained type approval for participation in the annual unit price purchase bid for the mechanical electric power system of Korea Electric Power System. At around May 26, 1993, the person in charge of the above business agreed to allocate the unit price to 34.6% in the case of items 30 above, LSP, Esex, 20.8% in the case of items, and 34.6% in the case of items 30 above, and the unit price to 16,089 won in the case of Korea Electric Cable Co., Ltd., Ltd., and on around 194, the Defendant Co., Ltd. obtained type approval from Korea Electric Power Co., Ltd., Ltd., and the new companies such as the participation in the bidding market. As the new companies enter the bidding market, the existing company allocated the unit price to the existing agreed certain ratio.

Based on such basic agreement, around August 21, 2007, at Esteex offices located at the king 46, Sungdong-gu, Seoul, F, Esteex G, the defendant company’s directors, I, and SJ of the Chang Telecommunication Co., Ltd., the volume of 40 items collected in 20% each, the volume of which was 25,416 won, Esteex’s unit price, 25,418 won, 25,415 won, 25,420 won, 25,420 won, 25,421 won, and 25,421 won, and 25,421 won, respectively, was awarded on the same day.

In addition, the defendant company is the defendant company.
