1. The plaintiff B's lawsuit shall be dismissed.
2. The plaintiff A's claim is dismissed.
3. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Details of the disposition;
A. The Plaintiff Company A (hereinafter “Plaintiff Company”) is a company whose business objective is the manufacturing and selling business of electronic electric meters, and Plaintiff B is a person who serves as the representative director of the Plaintiff Company.
The defendant is a quasi-government agency under the Act on the Management of Public Institutions established for the purpose of developing electric resources under the Korea Electric Power Corporation Act (hereinafter referred to as the "Public Institutions Operation Act").
B. On October 23, 2014, the Fair Trade Commission decided 1) with respect to the Plaintiff Company, on the ground that “the Plaintiff Company, LSSP Co., Ltd. (in the case of a stock company, the stock company is omitted), and the Korea Electric Cable Co., Ltd. agreed on the bid price and quantity with respect to the purchase bid ordered by the Defendant from 193 to 2010 as follows, constitutes an unfair collaborative act under Article 19(1)1 and 3 of the Monopoly Regulation and Fair Trade Act (hereinafter “Fair Trade Act”)”, the Fair Trade Act decided D (related to mechanical electric power supply bid) pursuant to Articles 21 and 22 of the Fair Trade Act, E (related to low-tension electronic power supply bid) and “the act of unreasonably restricting competition in the domestic power supply market, such as jointly determining the volume and quantity of the electric power supply to the owner of the stock market,” each of the above corrective orders and the above corrective orders, 200 D and 200 D and 400 (hereinafter “Fair.”).
(A) Collaborative act ELSK, Korean Electric Cable, Estet, Stex, Twit Telecommunication, Telecommunication, Twit Telecommunication, South Korean Cables, Ombudsman, omb system, the Plaintiff Company, the Plaintiff Company, the Telecompact, the compact, the patent transmission, the patent transmission, the IMM method, the same electric system, the paper sheet, and the paper sheet, as set out below, ordered by the Defendant from 1993 to 2010.
