[Defendant A] The defendant shall be punished by imprisonment for ten months.
However, the above sentence shall be executed for two years from the date of the final judgment.
Reasons
Punishment of the crime
Based on the facts acknowledged by the evidence duly adopted and investigated by the court, the court properly revised the criminal facts to the extent that it does not infringe the defendants' right to defense.
Defendants are not authorized to handle narcotics, and no person may smoke marijuana.
"2019 Highis181" and "201 Highis321"
1. At around 06:00 on July 3, 2019, Defendants A and B smoked marijuana in a way that Defendant A, in the residence of Defendant B, was in possession of a large amount of marijuana leaves, which Defendant A had been dried from a person who was not injured, such as a pipe, by putting them in a heading, in a string manner, and then inhales it with a fire.
2. On February 10, 2019, Defendants B and C expressed their intent to withdraw money and jointly purchase marijuana. On February 20:35, 2019, Defendant C sent bitco-in (0.4053BTC) equivalent to KRW 1.6 million in total to the electronic wallets used by the winners of their names who sell marijuana on the Internet “F” website, and then purchased it by means of finding about about 71g in the inside of the snow inserted near GGra, Seoul Special Metropolitan City, which was designated by Defendant C on the same day.
As such, the Defendants conspired to purchase approximately 71g of hemp from the person in an infinite name.
3. The sole criminal conduct of Defendant A;
A. Around 05:00 on February 8, 2019, the Defendant purchased marijuana 300,000 won in cash from the public toilets located in Yongsan-gu Seoul Metropolitan Government H, and purchased the marith in cash (the level of ordinary sprinkings).
B. On February 9, 2019, the Defendant: (i) around 18:00 on February 9, 201, is Aluminium located in the I building of Yeongdeungpo-gu Seoul Metropolitan Government; and (ii) Aluminium.
