A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall complete a child abuse treatment program for 120 hours.

Punishment of the crime

The defendant is a person in a de facto marital relationship with the victim C (nive, 46 years of age), and the victim D (9 years of age) is a de facto father-child relationship with the defendant with the children of the above C.

1. Child Welfare Violation;

가. 2012. 11. 초경 범행 피고인은 2012. 11. 초 새벽경 구미시 E에 있는, 피고인과 피해자들이 함께 거주하는 집에서, 피해자 D(당시 5세)이 늦은 시간에 몰래 텔레비전을 보았다는 이유로 “이 새끼가 어디 사람을 속여 간이 부어도 한참 부었네”라고 소리를 지르면서 손바닥으로 피해자의 뺨을 때리고, 피해자의 양 손목을 운동화 끈으로 묶어 마당으로 끌고 나간 다음 피해자의 손목을 머리 위로 올려 마당의 전선줄에 묶어 놓고 피해자에게 “조금이라도 움직이면 전기가 통하니까 꼼짝말고 있어라”라고 하여 약 2시간 동안 세워 두었다.

As a result, the defendant committed physical abuse against a child that may injure the child's body or injure the physical health and development of the child.

B. Around October 20, 2016, the Defendant committed the crime: (a) around 22:30 on October 20, 2016, at the home where the Defendant and the victims reside together; (b) at the home where the Defendant and the victims reside, the Defendant’s head was 3 times in a ward on the ground that the victims took out money from the Defendant’s branch before the Defendant’s honor; (c) the victim’s head was flicked three times in a ward; and (d) the food knick in a main room was sealed by “the same dead person” and “the same dead person”.

As a result, the Defendant committed physical abuse that may injure the body of a child, or injure the physical health and development of a child, and emotional abuse that may injure the mental health and development of a child.

2. Special violence;

A. On October 2012, the Defendant committed a crime in the middle of 2012, on or around 22:00 in the Defendant’s house as stated in paragraph (1) of Article 1, and under the influence of alcohol, the Defendant was under the influence of alcohol to the victim C, and the Defendant was under the influence of alcohol, and the Defendant was under the influence of the Defendant’s house without any string of why the inside and outside of the Republic of Korea is hick, and is under the influence of the victim C.
