A defendant shall be punished by imprisonment for two years.

2,505,500 won shall be additionally collected from the defendant.

Punishment of the crime

Even though the Defendant is not a narcotics handler, the Defendant treated the Mepter (one philopon; hereinafter “philopon”) which is a local mental medicine as follows.

1. Sale and purchase of phiphones;

A. On February 2017, the Defendant: (a) paid KRW 150,00 in cash to D around February 21, 2017, around February 21, 2017; and (b) received approximately 0.2g of philophones contained in vinyl packaging from D on the same place, at around February 2017.

Accordingly, the defendant purchased and sold philophones.

B. On February 11, 2018, the Defendant conspiredd to purchase approximately five g of phiphones from E and phiphones (Defendant 400,000 won, E 90,000 won) by sharing the purchase price of phiphones (Defendant 400,000 won).

On February 11, 2018, the Defendant and E paid 1.3 million won from the Defendant’s passenger car parked near the Nam-gu Incheon Metropolitan City G, to F, and 3.5g of the penphones contained in F in 7 for a day-to-day injection machine at the same location, and around that time, the amount of the penphones issued as above is less than the amount of the penphones that F intended to purchase, thus, the Defendant and E demanded to change the penphones. Around February 13, 2018, approximately 1g of the penphones contained in the one-day injection machine from F at the same place on February 17:20, 2018.

Accordingly, the Defendant conspired with E to sell and purchase philophones.

2. On February 2, 2017, the Defendant administered a philopon six times in total between around 21:00 and around February 14, 2018, as shown in the list of crimes in the attached Table, by inserting a philopon’s volume of approximately 0.05g philopon purchased as described in paragraph (a) in his own car that was parked in the vicinity of the 21:00 popon.

The defendant of "2018 Highest 1997" is not a person handling narcotics.

1. On December 10, 2016, the Defendant first committed the crime at around 19:00, in front of the funeral ceremony of the I Hospital located in Yangcheon-gu Seoul Metropolitan Government H, and the J is only available to him.
