A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

【The Defendant was sentenced to imprisonment for a violation of the Fisheries Act at the Jeonju District Court on August 28, 2015, with one year and six months in prison, and three years in suspended execution. On June 16, 2016, the Ulsan District Court sentenced the Defendant to one year in prison for a violation of the Fishery Resources Management Act, and the said judgment became final and conclusive on January 18, 2017.

[Criminal Facts]

1. The part of the past illegal capture of Defendant A, the owner of the D’s vessel that was already illegally captured, and the co-defendants (hereinafter referred to as the “defendants” for convenience) E, the above captain, the Defendant F, the Defendant G, the Defendant H, the Defendant I, and the J, in collusion with the above crew members of the D, decided to illegally capture mincing mincs on the coast.

On the other hand, no one shall capture or cultivate marine animals and plants by any fishing method other than those under the Act on Fisheries or the Management of Fishery Resources.

A. Defendant A, Defendant E, Defendant F, Defendant G, Defendant F, Defendant F, Defendant F, Defendant G, and Defendant I on board the said D, departing from the port of the former Sindo on March 15, 2016. On March 17, 2016, at around 14:00, Defendant G discovered a minc 1me at the sea near the Gnado on March 17, 2016, and Defendant G captured the said minc mincing at the above minc line, which was put on the waters of the murder that was prepared in advance on the said D deck, in order to prevent the said mincing from taking place at the sea.

As a result, the Defendants conspired to capture minc 1 ma in a manner other than permitted fisheries.

B. On April 4, 2016, Defendant A, Defendant E, Defendant H, Defendant G, Defendant H, and J are on board the said D and departing from the port of non-conception of the former North Gunsan City on April 17, 2016. On April 5, 2016, Defendant G discovered mincing a minc firstma at the sea near the fishing Cheongdo, and Defendant G is on the water surface prepared in advance on the said D deck.
