A defendant shall be punished by imprisonment for one year.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2013 Highest 1125"

1. On May 25, 2013, the Defendant: (a) accessed the Internet website’s “C” page using the Defendant’s smartphone at the high-dong SP4-88 purchase price, at around May 25, 2013, the Defendant confirmed that he/she would sell the said goods by visiting the said victim and making a false statement that he/she would sell the said goods when he/she deposits the sales price.

However, the defendant did not have the above goods, and there was no other asset or profit, and there was no intention or ability to sell the goods to the victim.

The Defendant, as such, by deceiving the victim, received 750,000 won as the price for goods through the Defendant’s new bank account at around 11:59 on the same day from the victim.

2. On July 13, 2013, the Defendant: (a) around July 13, 2013, the Defendant: (b) around the 2013rd, Gangdong-gu, Seoul; (c) the Defendant entered the Internet website using the Defendant’s smartphones; and (d) the Defendant purchased the KIKOs posted by the Victim F.

The phrase “the Defendant confirmed that he would sell the said goods upon contact with the said victim and made a false statement to the effect that he would sell the said goods. However, the Defendant did not possess the said goods and did not intend or have the intent to sell the said goods as he did not make any assets or profits otherwise, and the Defendant did not have any other intent or ability to make the said goods at the victim’s end. On or around 22:39 the same day, the Defendant, by deceiving the victim, received 520,000 won from the victim as the price for goods through the Defendant’s new bank account. On or around July 24, 2013, the Defendant was issued a KRW 520,00 from the victim’s new bank account on or around July 24, 2013.

The phrase " shall be confirmed, and the contact with the above victim shall be deposited in the purchase price.
