Reasons
1. Basic facts
A. On July 12, 2006, the Plaintiff completed the registration of ownership transfer with respect to the portion of 122.9/3768 square meters of land C in Gwangju Mine-gu (hereinafter “the Plaintiff’s land”). On December 7, 1998, the Defendant completed the registration of ownership transfer with respect to D land D in Gwangju Mine-gu and its ground buildings adjacent to the Plaintiff’s land (hereinafter “Defendant’s land”) on December 7, 1998.
In addition, the Plaintiff’s father, E, the Defendant’s father, is also adjacent to the Plaintiff’s land and the Defendant’s land. The Plaintiff’s land and the Plaintiff’s land are adjacent thereto, which completed the registration of ownership transfer on July 12, 1994.
나. 피고는 이 사건 원고 토지 중 별지 도면 표시 ㅅ, ㅂ, ㅁ, ㄹ, ㅅ의 각 점을 차례로 연결한 선내 (라) 부분 6㎡(이하 ‘이 사건 텃밭’이라고 한다)와 이 사건 인접 토지 중 일부를 텃밭으로 이용하고 있고, 이 사건 원고 토지 중 별지 도면 표시 ㅍ, ㅎ, ㄱ1, ㄱ, o, ㅅ, ㅂ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ의 각 점을 차례로 연결한 선내 (다) 부분 도로 124㎡(이하 ‘이 사건 도로’라 한다)를 이 사건 피고 토지 및 건물에 출입하기 위한 통로로 이용하고 있다.

2. Determination
A. According to the above facts, the defendant's possession of six square meters of the Plaintiff's land in this case as a garden is recognized.
However, in full view of the statements in Gap evidence No. 8 and the whole purport of the arguments, it is not confirmed whether the road of this case was packed, and the road of this case seems to be the only road for access to the defendant's land and building of this case.
Therefore, the Defendant’s use of the road of this case is solely based on such circumstances.
