1. It is confirmed that the first insurance contract entered in the separate sheet concluded between the Plaintiff and the Defendant is null and void.
2. The defendant.
Reasons
1. Facts of recognition;
A. On April 21, 2009, the Plaintiff concluded an insurance contract on April 21, 2009 with the Defendant as the insured and beneficiary, and on April 23, 2009, Nos. 1 (hereinafter “instant 1 insurance contract”); and No. 2 (hereinafter “instant 2 insurance contract”); and each of the aforementioned insurance contracts together referred to as “each of the instant 2 insurance contracts”; and the same includes a special clause that compensates the Defendant for KRW 20,000 per day of hospitalization when the insured is subject to general injury during the insurance period, and KRW 30,000 per day of hospitalization when receiving hospitalized treatment due to disease.
B. After that, on February 16, 2010, the Defendant changed the beneficiary of the instant second insurance contract, the beneficiary of the instant first insurance contract on February 22, 2010, and the policyholder of the instant second insurance contract on January 17, 201 from each of the Defendant to B, who is his/her father.
C. On May 20, 2009, the Defendant began to be hospitalized for 14 days at C Hospital and received treatment on the ground of the catum catum, etc., and up to April 9, 2015, the Defendant, as indicated in [Attachment 1], received hospitalized treatment for a total of 1,094 days (hereinafter “instant hospitalized treatment”). The Plaintiff paid KRW 7,910,000, and KRW 164,036,105 to the Defendant, respectively, as insurance money in relation to the instant hospitalized treatment.
