1.The judgment of the first instance shall be modified as follows:
The annexed sheet entered into between the Plaintiff and the Selection B.
Reasons
1. On April 23, 2009, Green Damage Insurance Co., Ltd. entered into an insurance contract with the Defendant as the insured on the basis of which the Defendant entered into an insurance contract with the same content as the attached Form (hereinafter “instant insurance”). This includes a special clause stipulating that: (a) where the insured is subject to hospital treatment due to a general injury during the insurance period, KRW 20,000 per day of hospitalization per day of temporary living expenses; (b) where the insured is subject to hospital treatment due to a disease, KRW 30,00 per day of hospitalization; and (c)
After that, on February 8, 2010, the Defendant changed the beneficiary of the instant insurance contract from the Defendant to B, and on January 12, 201, from the Defendant to B, the policyholder from the Defendant to the appointed party B. On May 3, 2013, the Plaintiff was transferred the status of the relevant green damage insurance company under the insurance contract by the ruling of the Financial Services Commission around May 3, 2013.
On May 20, 2009, the Defendant began to be hospitalized in C Hospital for 14 days on the ground of the salt panion and sludge, and received treatment from that point of time until July 13, 2013, the Defendant, as indicated in the “the details of hospitalization” table, received hospitalized treatment for 701 days in total under the name of disease, such as brain chronchosis, high blood pressure, liver infection, and urology (hereinafter “instant hospitalized treatment”); and the Plaintiff paid KRW 680,00 and KRW 30,463,632 to the Defendant, respectively, with the insurance money in relation to the instant hospitalized treatment.
