Basic Facts

The defendant is a company for the purpose of the taxi transportation business located in Yannam-gu, Namyang-gu, Namyang-do, and the plaintiffs were working or worked as a taxi driver belonging to the defendant.

In principle, Article 3 (Labor Type) of the Wage Agreement of 2007 is a two-day system, but a day-day system may be operated by a labor-management agreement.

Article 4 (Commencement and Closing Hours)

1. Two o'clocks in case of two o'clocks per day: Starting at 06 o'clocks, ending at 15 o'clocks, and break time shall be one hour;

P. P.M.: Starting operations at 16 p.m., ending operations at 01 p.m. of the following day, and setting one hour at break time.

Around September 1, 2007, the defendant made up of taxi workers belonging to the defendant a wage agreement between the National taxi industry trade union of Korea and the Gyeonggi Military Trade Union of Korea (hereinafter referred to as the "Plaintiff's Union") on and around September 1, 2007.
