1. 피고인 A, B, C, D, E, F, G, H, I, J 피고인들은 N, M과 함께, 피고인 A는 상습으로, 2016. 7. 8. 00:00 경부터 같은 날 03:45 경까지 사이에 충북 진천군 O에 있는 피고인 A의 집에서 화투 20 장을 이용, 5 장씩 1패로 하여 4개의 패를 나누고, 속칭 ‘ 오야 패 ’를 제외한 나머지 3 곳의 화투패 중 임의로 선택한 패에 돈을 건 다음 각 패의 5 장 중 3 장으로 10, 20, 30을 만들고, 나머지 화투 2 장의 끝수를 비교하여 더 높은 쪽에 돈을 건 사람이 이겨 판돈을 가져가는 속칭 ‘ 도리 짓고땡’ 방식으로 수십 회에 걸쳐 줄도 박을 하였다.
