Reasons
Punishment of the crime
[criminal power] On May 25, 2016, the Defendant was sentenced to imprisonment with prison labor for one year and a fine of 300,000 won for the violation of the Road Traffic Act (unlicensed Driving) and for larceny, etc. in the Jinwon District Court’s Jinju Branch on September 27, 2016. On September 11, 2016, the Defendant was sentenced to imprisonment with prison labor for larceny, etc., and completed the execution of the sentence in the Changwon Prison on June 11, 2017.
【Criminal Facts】
1. The Defendant: (a) around 04:00 on November 2, 2017, the Defendant: (b) opened a door of the said cargo vehicle that was parked on the street in the front of the “Catt” in Jinju-si; (c) opened the instant cargo vehicle in front of the instant cargo vehicle owned by the victim D; and (d) cut off the cargo vehicle in front of the instant cargo vehicle owned by Jinju-si; and (c) cut off the said cargo vehicle in excess of KRW 6
2. Violation of the Road Traffic Act;
A. On November 2, 2017, around 04:00, the Defendant driven the freight vehicle under the foregoing paragraph (1) at a section of about 40 km from the front side of the “Cmat” in Jinju-si B to the Buddhist land located in Jinnam-gun F, Jinnam-gun without a driver’s license.
B. On November 2, 2017, at around 18:00, the Defendant driven the cargo vehicle under the said Paragraph 1 without a driver’s license from approximately 20 km section from the insular area F in Gyeongnam-gun to the vacant area located in Jinju-si G, Jin-si.
C. On November 4, 2017, the Defendant, at around 23:40, driven the freight vehicle under the said Paragraph (1) from the factory sites located in G to the influence in Jin-si, Jin-si, to the influence in Jin-si, without a driver’s license.
On November 9, 2017, around 13:15, the Defendant driven the cargo vehicles under the above paragraph (1) without a driver’s license from the official land located in G in J to the influence in the alternative Dong in Jin-si.
E. On November 10, 2017, at around 03:40, the Defendant driven the freight vehicle under the said paragraph (1) from a factory site located in G to the vicinity of the Corporation in Jinju-si, from around 1km-dong to Jin-si, without a driver’s license.
F. On November 12, 2017, the Defendant is located in G at J at J, J around J, around 13:00.
