Reasons
Punishment of the crime
The Defendant, as a person operating E in Seocho-gu, Seoyang-gu, Seoyang-si, who is requested to repair a vehicle destroyed by a traffic accident, was able to obtain insurance proceeds by submitting a written estimate of repair, as if he replaced or repaired a part that has not been actually repaired, by inserting the repair photograph of another vehicle other than the requested vehicle into a normal repair photograph.
1. Around May 5, 2015, the Defendant’s fraud: (a) received a request for repair of a F rocketing car from the above E and received the payment of KRW 1,323,685 in excess of the difference from the victim company, even though the actual cost of repair was KRW 2,863,315; and (b) as such, the Defendant submitted a written estimate of KRW 4,187,000 as if the parts not actually repaired were replaced or repaired by means of inserting the repair photograph of another vehicle.
In addition, from February 7, 2013 to January 26, 2016, the Defendant enticed victims by the same method 73 times in total, such as the list of crimes, and received the total amount of KRW 12,738,125 from victims.

On January 13, 2016, the Defendant: (a) received a request for the repair of the GGGGGGGGGGG vehicle in question; and (b) the Defendant was 2,509,92 won of the actual cost of repair; (c) provided a written estimate of KRW 4,486,249, as if the parts not actually repaired were replaced or repaired by means of inserting the repair photograph of another vehicle; and (d) sought a further payment of KRW 1,976,257 of the difference by submitting a written estimate of KRW 4,486,249, as if the parts not actually repaired were replaced or repaired by means of inserting the repair photograph of the other vehicle. However, the Defendant attempted to receive more than KRW 1,976,25
