Punishment of the crime

『2018 고단 1605』 피고인은 2018. 1. 5. 서울 관악구 B, 103호에서 인터넷 포털사이트인 ‘ 네이버’ 의 ‘ 중고 나라’ 카페 게시판에 ‘ 에어 팟( 이어 폰)’ 을 판매하겠다는 내용의 글을 게시하였고, 위 글을 보고 연락한 피해자 C에게 전화로 ‘170,000 원에 판매하겠다’ 고 거짓말을 하였다.

However, even if the defendant received the sales proceeds from the injured party, he did not have the intention or ability to sell it.

As such, the Defendant, by deceiving the victim, was transferred KRW 170,000 from the victim to the corporate bank account under the name of the Defendant on the same day.

In addition, the Defendant received a total of KRW 675,00 from four victims, as shown in attached Table 1, in the same manner from around the above day to around the same month.

『2018 고단 3193』 피고인은 2018. 2. 25. 경 서울 관악구 D, 103호에 있는 피고인의 집에서 인터넷 포털사이트인 ‘ 네이버’ 의 ‘ 중고 나라’ 게시판에 ‘ 에어 팟( 이어 폰)’ 을 판매하겠다는 내용의 글을 게시하였고, 위 글을 보고 연락한 피해자 E에게 전화로 ‘17 만 원에 판매하겠다 ’라고 거짓말을 하였다.

However, even if the defendant received the sales proceeds from the injured party, he did not have the intention or ability to sell it.

As such, the Defendant, by deceiving the victim, received KRW 170,00 from the victim to the corporate bank account in the name of the Defendant, and received KRW 3,528,00 in total from around the above day to April 2, 2018, as shown in attached Table 2 of the List of Crimes, 10 times from around the above day to April 2, 2018.
