A defendant shall be punished by imprisonment for one year.

The request of the applicant for compensation shall be dismissed.

Punishment of the crime

1. 『2017 고단 1439』 피고인은 2017. 4. 2. 충남 금산군 중부 대학교 근처에서 인터넷 중고 물품 거래 사이트인 ‘ 번개 장터 ’에 무선 이어폰인 ‘ 애플 에어 팟’ 을 판매한다는 피고인 작 성의 게시 글을 보고 연락해 온 피해자 D에게 “ 대금을 보내면 ‘ 애플 에어 팟’ 을 판매하겠다 ”라고 말하였다.

그러나 피고인은 사실 위 에어팟을 가지고 있지 아니하여 피해 자로부터 물품대금 명목으로 돈을 받더라도 피해자에게 이를 판매할 의사가 없었다.

Nevertheless, the defendant deceiving the above and transferred 230,000 won to the Agricultural Cooperative Account (Account Number: E) in the name of the defendant on the same day from the victim.

Accordingly, the defendant acquired the victim's property by fraud.

2. On May 25, 2017, the Defendant: (a) posted a notice on a place where the place of light is unknown on May 25, 2017, stating that “The sales of a son 7 Handphones are sold” on the Internet Nene and a foreign website; and (b) sent the price to the victim F who reported and contacted, the Defendant would sell a 7 Handphone.

In a false manner, 530,00 won was transferred from the injured party to the Agricultural Cooperative Account (E) in the name of G on the same day, and from that to July 29, 2017, 2,45,000 won was transferred in total from the victims to six times in the same manner as in the list of crimes in the same manner.

3. "2017 Highest 1857".

A. On March 15, 2017, the Defendant: (a) up to March 15, 2017, on the part of the victim H, posted an article to the effect that “A” would sell a phone 7 plug to “the victim H who reported and contacted the article to the effect that I would sell the phone 7 plug,” the Internet trading site; and (b) deposited the payment to the victim H., he would send a phone 7 plug to the effect that I would send the phone.
