【Criminal Facts】

1. Interference with business;

A. At around 04:00 on February 17, 2020, the Defendant interfered with the victim’s restaurant business by force by avoiding the disturbance for about 20 minutes, including, without any reason, the Defendant, in “D” operated by the victim C located in Pyeongtaek-si B, who takes a large voice to the victim without any reason while under the influence of alcohol, carrying tobacco, and returning to the said restaurant.

B. On February 17, 2020, at around 04:30, the Defendant: (a) ordered a cream with “G” managed by the Victim F located in Pyeongtaek-si E, and (b) took a bath to other customers with a large amount of noise without any justifiable reason while under the influence of alcohol; and (c) committed a disturbance for about 30 minutes by avoiding the disturbance, and obstructed the victim’s restaurant business by force.

2. Damage to public goods;

가. 피고인은 2020. 2. 17. 06:00경 평택시 H에 있는 I 앞 도로에서, 평택경찰서 J지구대 소속 순경 K, 순경 L가 “할아버지 한분이 치매인지 술에 취한 건지 술을 먹겠다고 하면서 울고 있다.”라는 112신고를 받고 출동하여 술에 취한 피고인을 M 순찰차에 태워 피고인의 주거지로 이동하던 도중 갑자기 아무런 이유 없이 위 경찰관들에게 “N이 우리 집이야 빨리 가!” “씹할 놈들아 형을 우습게 아느냐”, “너네는 마빡을 맞아야 정신을 차린다”, “나랑 한판 하자.”라고 욕설을 하며 발로 위 순찰차 안에 있는 안전 가림막을 수회 걷어 차 위 순찰차를 수리비 825,000원 상당이 들도록 손괴하였다.
