[Defendant A] The defendant A shall be punished by imprisonment for eight months.

However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is a person who intends to become a candidate for the second time of the election of the head of the National East City Cooperative (hereinafter referred to as the “C Association”) that is scheduled to implement on March 13, 2019 as the head of the former C Association, and the defendant B is the spouse of the defendant A.

In relation to the election of the head of a cooperative, the head of the cooperative shall not make contributions while in office, and no one shall provide money to electors (including those eligible to be recorded on the relevant electoral register before the electoral register is prepared) or their family members for the election campaign, and shall conduct an election campaign unless the period of election campaign is not, and shall not visit each elector for an election campaign.

1. The sole crime committed by Defendant A;

A. Around 15:40 on December 8, 2018, Defendant A promised D to contact with “E Licensed Real Estate Agent’s Office operated by D” by telephone from CF members of the CF on December 15:40, 2018. At around 16:30 on the same day, Defendant A continued D to contact with the said E Licensed Real Estate Agent’s Office located in Gwangju F. On the same day, “I am, I am, and I am back with a bag with KRW 300,000 in cash prepared in advance, from that time to February 8, 2019, and provided 60,000 won in total to all members of CF for election campaign as indicated in attached Form [1] from that time to February 3, 2019, and election campaign by no later than 3:50,000 won for election campaign (from February 15, 2018; No. 13788, Feb. 31, 2019).

B. At around 20:00 on January 17, 2018, Defendant A made contributions to C’s members of the Association, stating that “A shall pay KRW 100,000,000,00 to C’s members of C’s restaurant located in Gwangju.”
