Defendant
A has served four times as the president of the C Association, and two times at the same time, the two times of election of the president of the D Association, but failed, and Defendant B served as a candidate for the president of the C Association, and Defendant B served as the secretary general of the G Committee while operating the “F cafeteria” in E as a member of the C Association. The chairman is currently H.
1. The offering, expressing an intention to offer, or promising to offer money, goods, entertainment, etc. to an elector, his/her family member, or the elector for the election campaign against a defendant A;
A. The Defendant, who provided money to B, was willing to leave B as a candidate for the president of the CF in the second simultaneous elections for the president of the DF at the same time, requested B to assist in an election campaign for the purpose of securing electors from December 2, 2018 to January 2019, which was accepted by B, to offer money to C members when the Defendant prepared money together with B.
On January 21, 2019, the Defendant: (a) provided B with cash amounting to KRW 20 million (50,000) as a fund for election campaign in F cafeteria; (b) provided B with cash amounting to KRW 90 million (50,000) from “F cafeteria” around the 25th day of the same month; and (c) provided B with cash amounting to KRW 110 million (50,000) twice for election campaign purposes.
Accordingly, the defendant provided money to the elector for the election campaign.
B. Around 19:00 on February 19, 2019, the Defendant provided money to I, the head of K fishing village fraternity provided that “I will go to an election for the head of the cooperative, but will go to the election of the head of the cooperative.” The Defendant provided KRW 200,000 in cash ( KRW 50,000) at the juvenile training center at the entrance of J Village.
Accordingly, the defendant provided money to the elector for the election campaign.
2. Defendant B, from “F restaurant” to “F restaurant,” the Defendant around January 21, 2019, paid in cash of KRW 20 million (50,000) and around January 25, 201, in cash of KRW 90,000 (50,000) around the same month.
