A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant, who entered the Republic of Korea around November 30, 2003 on the real name of D (D, E) and stayed illegally in Korea despite the expiration of the period of stay on June 22, 2004, the defendant was subject to a disposition of departure order and postponement of visa regulation after filing a voluntary report on January 12, 2007.

The defendant knew that he could not re-entry the Republic of Korea upon departure from China after receiving the above disposition, and had the intention to re-enter the Republic of Korea using a name passport to prevent the immigration authorities from ascertaining the existence of the above disposition.

Accordingly, the Defendant, upon request by Jeonnam-ro F, made and delivered a passport under the name of "A" (A, E) upon request by the branch of G located in China through Jeonnam-ro F, and applied for a visa for visiting (F-1) residing at the Embassy of Korea during the week, and obtained permission on December 29, 2006.

On February 23, 2007, the defendant possessed a false passport under the name of "A" and re-entry the visa of "F-1" with the visa of "F-1" international passenger terminal of Incheon port. On February 27, 2007, around Seoul Immigration Control Office, the defendant prepared and submitted an application for alien registration with a false passport under the name of "A" for the purpose of staying in the Republic of Korea, and filed it with the foreigner for the status of stay (F-1) residing together with the visit.

On January 7, 2008, the Defendant: (a) around January 7, 2008, kept a false passport under the name of “A” in the Incheon Airport located in Jung-gu Incheon city, Jung-gu, Incheon; and (b) went through the departure inspection by submitting to the public official of the Incheon Airport Immigration Management Office in charge of departure inspection, who is in charge of departure inspection, the personal descriptions of the above name passport, as if it were his/her genuine personal information.

Accordingly, the defendant interfered with legitimate execution of duties concerning departure inspection duties of public officials in charge of the Incheon Airport Immigration Management Office by fraudulent means.

2. On January 24, 2008, the Defendant committed a crime by around January 24, 2008.
