A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On November 14, 2019, at around 17:50, the Defendant causing special property damage, the victim was “E” in the indictment of the victim D Co., Ltd. on the street in front of the “C” located in Busan Metropolitan City, but the crime of causing property damage is an ownership crime under the benefit and protection of another’s ownership, and is not an issue whether the owner of FF taxi occupies the property. According to the records of this case, it is recognized that the owner of FF taxi is D Co., Ltd., and even if the victim was corrected to D Co., Ltd., the victim did not substantially disadvantage the Defendant’s exercise of the right to defense, the victim is corrected to “E” ex officio as “D Co., Ltd.....”

Accordingly, the defendant carried dangerous objects and damaged the victim's property.

2. No motor vehicle registration number plate and seal affixed to a motor vehicle violating the Motor Vehicle Management Act shall be removed without permission of the Mayor/Do Governor;

Nevertheless, the Defendant damaged the front glass of the taxi in operation of E at the time and place described in Paragraph 1, such as described in Paragraph 1, and removed “F”, which is the registration license plate, in front of the taxi, to prevent E from operating the taxi.

Accordingly, the defendant removed a motor vehicle registration number plate and a seal without permission.

3. The Defendant was unable to prevent the victim from operating the taxi by destroying the front glass of the victim E-operation taxi and removing the registration license plate and seal, at the time and place described in paragraphs (1) and (2).

Accordingly, the Defendant interfered with the victim's taxi business by force.
