Punishment of the crime

C is the director of the management office of the apartment complex D, the defendant A is the head of the management office, the defendant B is the entrusted management service company of the above apartment complex, and the defendants and C are the personal information manager who manages the personal information of the above occupants.

No person who has managed or processed personal information shall divulge personal information he/she has become aware of in the course of performing his/her duties or provide it to another person without authority.

1. On February 3, 2020, the Defendant: (a) at the D Apartment Management Office around Bupyeong-si, Seocheon-si; (b) prepared a list of voters, stating information by which the occupants of 11 households, such as the number of households and names of the occupants of the D Apartment E-si, can be identified; and (c) posted it on the front of the head of the Ban’s apartment guard G through the head of the Ban.

Accordingly, the defendant revealed the personal information of the occupant in the course of performing the duties of the apartment management office.

2. On January 10, 2020, Defendant B Co., Ltd., and C had C and A violate the Personal Information Protection Act by neglecting to exercise due care and supervision over the Defendant’s relevant duties in order to prevent a violation as set forth in paragraph (2) by having C and A violate the Personal Information Protection Act, on the following grounds: (a) prepare a list of occupants’ consent to dismissal of the chairman of the election management committee, stating the total number of households of 138 households, including the number of households, name, etc. of J from the occupants of the apartment I head of the apartment; and (b) posted it on the front of each building site through the head of the Ban of apartment expenses.
