A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 19, 2018, the fraud Defendant made a false statement to the victim HJ stating that “on the part of remitting money, the Defendant would deliver the money to the Defendant’s AMF account,” even if the Defendant did not have any goods sold, the Defendant made the victim transfer KRW 300,000 of the money to the Defendant’s AMF account.

Accordingly, the defendant was given property by deceiving the victim.

2. On October 2018, the Defendant embezzled, around 21:00 on the first day of possession, the Defendant: (a) obtained one copy of the driver’s license of a motor vehicle owned by the victim AE and embezzled it without taking necessary measures, such as returning it to the victim, on the roads near the mutual influence village located in the new and French Dong, Dongjak-gu Seoul Metropolitan Government; (b) around October 2018.

3. Illegal uttering of official documents, and fabrication of private documents;

A. On November 2, 2018, the Defendant, at around 14:35, 2018, proposed that he was the Defendant’s driver’s license under the name of the head of Seoul Provincial Police Agency, a public document, that he was a first class of AE’s ordinary driver’s license under the name of the head of Seoul Provincial Police Agency while leasing HN rocketing vehicles from HL staff members of HL, and that he was the Defendant’s driver’s license, and had the said HM state “BA” in the vehicle number column using a black pen, and signed “AE” in the signature column. Accordingly, the Defendant denied the official document and forged a first class of AE’s driver’s license under the name of the Seoul Provincial Police Agency, a private document, for the purpose of exercising the rights and duties on the building, with the intention of using it.
