피고인은 2012. 9. 14. 01:04경 인터넷 커뮤니티인 ‘일베저장소’(www.ilbe.com)에 접속하여 일베 게시판에 피해자 B이 일요시사와 인터뷰한 내용을 옮겨놓은 ‘개도둑년 지랄도풍년.Gisa’라는 제목의 게시글에 ‘C’라는 대화명으로 “저 썅년 뮤지컬 하는년이랑 닮은것 같다. 난타도 뮤지컬에 속하는지는 의문이다만”이라는 댓글을 작성, 게시함으로써 피해자를 공연히 모욕하였다.
