피고인은 2013. 12. 6. 15:32:40경 부산 사하구 B아파트 501호에 있는 피고인의 주거지에서, 인터넷 일간베스트저장소(www.ilbe.com)의 일베 게시판에 "비.구.니.고.소.미.시.즌 열렸다ㅋㅋㅋㅋㅋㅋㅋ"라는 제목으로 고소인이 일베저장소 회원들의 악플에 대하여 고소하겠다고 트위트에 쓴 글이 캡쳐되어 게시된 글에 닉네임 "C"로 로그인하여 "시발 땡중년이 맨날 트윗만 하나 으휴 ㅉㅉ"(www.ilbe.com/ D)라는 댓글을 게시하여 공연히 고소인을 모욕하였다.
