1. Defendant A shall be punished by imprisonment with prison labor for one year.

However, the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.

A A is a person who operated a game hall registered as the juvenile game industry on the trade name from around April 27, 2018 to May 15, 2018, "F", and Defendant B was an employee in charge of money exchange affairs in the said game hall from around May 3, 2018 to May 15, 2018.

No one shall exchange, arrange for exchange or re-purchase of tangible and intangible results obtained through the use of game water, and no game water-related business operator shall allow any person to do gambling or other speculative acts using game water or leave such act to do so.

그럼에도 피고인들은 2018. 4. 27. 경부터 2018. 5. 2. 경까지 는 피고인 A 단독으로, 2018. 5. 3. 경부터 2018. 5. 15. 경까지 는 공모하여, 위 게임 장에 ‘ 뉴 팬 텀 퍼펙트게임’ 70대를 설치한 다음 게임 장을 찾아온 불특정 다수의 손님들에게 위 게임기의 이용을 통해 획득한 점수가 저장되는 IC 카드를 제공하여 게임기에 투입하게 하고, 손님들의 조작 없이도 게임이 진행되도록 자동 누름장치( 일명 ‘ 똑딱이’ )를 제공하여 이용하게 하면서, 손님이 게임기에 현금을 투입하고 게임을 실행하여 손님의 게임 캐릭터가 다른 캐릭터와 대결하여 이기면 점수를 획득하는 방법으로 게임을 하도록 하였고, 이와 같은 게임 과정에서 손님이 획득한 점수가 IC 카드에 입력되면 그 카드에 입력된 점수에 따라 점수 보관 증을 발급해 주고, 게임 장 뒷문 계단 옆에서 피고인 B 등 종업원이 점수 보관 증에 기재된 점수 1점 당 1원으로 계산한 후 10% 의 수수료를 공제하고 환전해 주었다.
