그럼에도 피고인들은 2017. 2. 9. 경부터 2017. 2. 24. 경까지 사이에 위 H 내에 'PHANTOM' 게임 기 70대를 설치한 뒤 게임 장을 찾아 온 불특정 다수의 손님들에게 같은 게임기의 이용을 통해 획득한 점수가 저장되는 IC 카드를 제공하여 게임기에 투입하게 하고, 손님들의 조작 없이도 게임이 진행되도록 자동 진행장치( 일명 똑딱이 )를 제공하여 손님들 로 하여금 이용하게 하면서, 현금 10,000원을 투입하면 점수 창에 100점이 찍히고 1회 게임 당 1점이 차감되는 방식으로 게임을 진행하되 번개, 불빛, 장군, 용, 돌발 등 특정 그림이 화면에 나오는 경우 10,000점부터 수백만 점이 당첨되게 하는 방법으로 게임을 하도록 하였고, 이와 같은 게임 과정에서 손님이 획득한 점 수가 위 IC 카드에 입력되면 그 카드에 입력된 점수를 게임 장 출입문 앞 계단에서 피고인 B 등 환전업무를 담당하는 사람이 100점 당 10% 의 수수료를 제하고 9,000원에 환전해 주었다.
