A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. C를 통한 장물운반ㆍ보관의 점 피고인은 도난 또는 분실 스마트 폰( 이하 ‘ 장 물 스마트 폰’ 이라고 한다) 매입 총책인 성명 불상자( 위 챗 대화명 ‘D’ 등 사용), 장물 스마트 폰 운반 책인 C와 함께, 피고인이 성명 불상 총책으로부터 지시 받은 내용을 C에게 전달하면 C가 그 지시에 따라 장물 휴대전화를 매입한 후 이를 지하철 물품 보관함에 넣거나 서울, 경기 일대에서 중국 보따리 상을 만 나 이를 전달하는 방식으로 장물 스마트 폰을 운반하기로 모의하였다.

C는 위 공모 내용대로, 2017. 8. 초순경 피고인의 지시에 따라 피고인이 위챗을 통하여 지정한 사람으로부터 그가 절취 또는 습득한 피해자 E 소유의 시가 불상의 아이 폰 6S 스마트 폰 1대가 장물이라는 사실을 알면서도 이를 매입한 후 그 무렵 서울, 경기 일대에서 장물 인 위 휴대전화를 피고인이 지정한 보따리상에게 전달하였다.

The Defendant, in collusion with the above name in total liability, and C from around that time to August 24, 2017, transported each stolen article over a total of six times, such as the list Nos. 1 to 6 per annum of the annexed crime list (1). The Defendant stored each stolen article over four times, such as the list Nos. 7-10 per annum of the annexed crime list (1).

2. When the Defendant was detained in the lower court on August 8, 2017 and thereafter C was unable to seek a person to directly transport stolen smartphones, the Defendant, along with his/her name and influenites, purchased stolen cell phoness in accordance with the instructions of the Defendant’s name and influences, and intended to transport stolen smartphones by means of inserting them in the storage of subways after purchasing the stolen cell phone in accordance with the instructions of the Defendant’s name and influences, or delivering them in Seoul and Japan.

In accordance with the above public offering, the defendant is owned by G from his residence in Gwangjin-gu Seoul Special Metropolitan City on September 22, 2017.
