A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On December 2, 2015, the Defendant: (a) received a proposal from China to transport smartphones that were stolen or lost from C in the Republic of Korea (hereinafter referred to as “the stolen smartphones”) to China; and (b) consented to it; (c) around that time, the Defendant made a proposal to transport and sell the stolen smartphones to D, which is a woman of Chinese shipbuilding, to China; and (d) accepted this.

As a result, D made the Jung-gu Incheon Metropolitan City E with the oil company "F", and the general manager of Korea, who delivered stolen smartphones through the Defendant's home line in accordance with the direction of the Defendant, carried them in Korea, was willing to take charge of transporting stolen smartphones from China to China through D, and G is responsible for transporting stolen smartphones from Korea to China.

1. Transportation of stolen goods;

A. On December 24, 2015, the Defendant and D had D transport 12 copies of smartphones from around 14:00 to February 5, 2016, as described in the attached Table 1, by allowing D to transport two cellphones from the market price and the type of non-name smartphones to the Defendant’s office located in the Incheon International Airport located in Jung-gu Incheon International Airport.

Accordingly, the defendant transported stolen goods in collusion with D.

B. On December 5, 2015, the Defendant, D, and G’s joint crimes, as seen above, had G transport three of the market value and three of the non-nameless cellphones smartphones at the Incheon Jung-gu Airport, Incheon International Airport (271), which were delivered by H, under the direction of the above F, to dispatch the phone of the non-named person’s name to the Defendant’s office located in China at the Incheon International Airport.
