1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. From December 2017, the Plaintiff operated the D fishing place located in B local governments C (hereinafter “instant land”) (hereinafter “instant fishing place”).

B. On March 27, 2018, the Director of the Local Agricultural Technology Center ordered the Plaintiff to reinstate the instant fishing place on the ground that the instant fishing place did not obtain permission under the Fishing Management and Promotion Act (hereinafter “Fishing Management Act”).

C. On April 25, 2018, the Plaintiff filed an application for registration of the instant fishing place business with the Defendant, and on May 1, 2018, the Director of the National Agricultural Technology Center B issued a notification to the Plaintiff that the registration of the instant fishing place business was not possible under his/her name (hereinafter “instant notification of refusal”).

On August 13, 2018, the Plaintiff filed an administrative appeal seeking confirmation of invalidity of the rejection notification, etc. of this case with the Gyeonggi-do Administrative Appeals Commission, and the Gyeonggi-do Administrative Appeals Commission rendered an administrative appeal on August 13, 2018, and determined that the rejection notification of this case was made by an administrative agency without authority and thus, accepted

E. On August 30, 2018, the Plaintiff filed an application for registration of the instant fishing place business with the Defendant again, and on August 30, 2018, the Defendant notified the Plaintiff that the registration of the instant fishing place business is not possible (hereinafter “instant disposition”).

[Grounds for non-payment] Article 38 of the Framework Act on Environmental Policy, Article 13 of the Enforcement Decree of the same Act, designation of a special measures area for the preservation of water quality of EF water sources and special comprehensive measures (hereinafter “instant notice”): The area Ⅰ does not allow the registration of a fishery business (including a fishing place business) under Articles 6, 9, and 11 of the Inland Water Fisheries Act, or Articles 10 and 16 of the Fishing Management Act. The Plaintiff’s application for correction and purport of the instant disposition by changing the Defendant to B local government on September 2, 2018.
