Defendant shall be punished by a fine of KRW 3,000,000.

Where a defendant fails to pay a fine, 50,000 won shall be one day.

Punishment of the crime

The defendant was the chairperson of the Daegu-gu Committee for Emergency Countermeasures against Apartment C Apartments, and the victim D, the chairperson of the council of occupants' representatives.

1. On October 26, 2012, the Defendant, in the above apartment C’s apartment, stated in the notice that “D is not in contact with, or has not violated any provision with, a business entity during the process of replacing the above apartment water supply pipes, and notwithstanding the fact that it embezzled public funds, the Defendant has damaged the reputation of the victim by publicly offering false information by openly delivering the said apartment at each apartment house on the same day, with the fact that “D is not known to the Emergency Countermeasure Committee, despite the fact that it falls short of the quorum by seven resolution for replacing the water supply pipes.” The Defendant is insufficient to pay KRW 500 million, which is the cost of replacing the water supply pipes, with the long-term repair appropriations, regardless of the absence of a meal for using the public funds as of February 9, 2012.”

2. On November 7, 2012, the Defendant posted a banner stating that “D in the same way fluor, fluor, children’s playground, and 105 dong and 106 dong space in the apartment complex,” “D without and without capacity and influoring, and disregarding the occupants”, “D that makes a false statement at a resident assembly,” “Each fluor,” “D that only makes a false statement at a resident assembly,” and “D that is contrary to and disregarding the resident, i.e., resignation., resignation.”

However, the victim had the public corporation-related person perform the defective construction work.

Although there was no fact that the Defendant made a specific false statement to the occupants, the Defendant undermined the honor of the victim by pointing out such false facts as above.
