The punishment of the accused shall be determined by a year of imprisonment.

However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

Defendant is not a narcotics handler.

The Defendant, together with C, conspired to purchase and administer Metepopa (one philopopon; hereinafter “philopon”) which is a local mental medicine.

1. Sale and purchase of phiphones;

A. According to the foregoing public invitation, around 12:34 September 24, 2016, the Defendant wired KRW 200,000 of the purchase price of philopon to the bank account (F) of the E-person’s bank account used by D, and C, around 20:00 on the same day, in collusion with C by receiving approximately 0.35 g of philopon from D from the stairs of the Nam-gu Incheon Metropolitan City 104 parking lot around the same day.

B. According to the above public offering, the Defendant remitted KRW 200,000 to the bank account (H) of D on October 1, 2016, and C, around 19:20 on the same day, in collusion with C in a manner of bringing about approximately 0.35 g of phiphones concealed in the gap of the 4th floor and the 5th floor stairs, Nam-gu, Incheon Metropolitan City, Incheon, about 19:20 on the same day.

Pursuant to the foregoing public offering, C wired KRW 3.50,00 of the purchase price of philopon to the bank account (F) of the E-person used by D around December 23, 2016, and around the following day, C transferred approximately 0.7g of philopon from D within C’s car (K) parked in front of the J in Yeonsu-gu Incheon at the time of the new wall.

The Defendant conspired with C in collusion with C by the foregoing method to sell and purchase phiphones.

According to the above public offering, C bears half of the amount of KRW 400,000 of the purchase price of philophones, together with L, which is the seat of D on January 14, 2017, and intends to purchase approximately 0.7g of philophones from M, which is the seat of D, around the same day, and around the same day, C brings about about 0.7g of philophones hidden in the outside room of the Nam-gu Incheon Metropolitan City 106-dong 106-dong 106, and takes about 0.7g of philophones concealed in the outside room, and at the same time, 40,000 won of the purchase price of philophones are added to tax calculation.

The Defendant, in series, conspired with C and L by the foregoing method, sold philophones.

2. Medication of phiphones.
