A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
On August 20, 2015, the Defendant was sentenced to two years of imprisonment with prison labor for night building intrusion and larceny at the Jeju District Court on June 20, 2015, and the judgment became final and conclusive on August 28, 2015. On January 25, 2017, the said court was sentenced to eight months of imprisonment with prison labor for night building intrusion and larceny, etc. on May 18, 2017, and the said suspended sentence became final and conclusive on May 18, 2017, and the said suspended sentence was invalidated on December 22, 2017 and the period of parole was expired on February 8, 2018.
1. Night-time theft of buildings;
A. On November 10, 2018, around 06:15, the Defendant committed the crime against the victim B: (a) opened an unlocked window at the “D” restaurant operated by the victim B in Jeju-si; and (b) went into the said package, and used a total of KRW 100,000,000 in cash owned by the victim, which was kept in the C-si Treasury, and stolen it.
Accordingly, the defendant invadedd the building managed by the victim at night and stolen the property.
B. On November 23, 2018, around 04:03, the Defendant: (a) opened an unlocked window at the “G” coffee shop operated by the victim E, which was located in the Jeju city F; and (b) went into the inside, and stolen the total amount of KRW 138,000 in cash owned by the victim, which was kept in the Central Treasury, after intrusion into the said box; and (c) stolen it.
Accordingly, the defendant invadedd the building managed by the victim at night and stolen the property.
2. Intrusion upon a structure and theft;
A. From 07:00 to 08:00 on October 2018, the Defendant: (a) opened a “J” restaurant of the victim H operation of Jeju city during the period from 07:00 to 08:00 on the date; (b) opened an unclaimed window to steals an object to steals it; and (c) intruded into it; and (d) cited a total of KRW 200,000 in cash owned by the victim and kept in the CF.
Accordingly, the defendant invadedd on a structure managed by the victim, and stolen the property owned by the victim.
B. The Defendant committing a crime against the Victim K is L from October 31, 2018 to October 07:00 to 08:00.
