A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Night building thief and night building thief;
A. On December 28, 2018, around 02:20 on December 28, 2018, the Defendant: (a) obstructed the victim C’s office located in Dong-gu, Nam-gu, Dong-gu; (b) obstructed the building, and did not discover the object to be stolen, but did not constitute an attempted crime.
B. On December 28, 2018, around 02:37, the Defendant continued to intrude into the G convenience point managed by the victim FF of the victim in Dong-gu, Nam-gu, Dong-gu, Chungcheongnam-gu, by the Defendant, through the above convenience point, and then cut off the cash amounting to the sum of KRW 756,000 and the market value of KRW 112,00,000 in the total amount of KRW 112,00 in the market value, namely, KRW 56,00 in the face value, KRW 56 in the face value, KRW 22,50 in the market value, and KRW 50 in the amount of KRW 2,50 in the market value.
Accordingly, the Defendant stolen cash and property worth 890,500 won in total after intrusion into a structure at night.
C. On February 16, 2019, around 01:43, the Defendant, through the window of convenience points that was not set up for the first time in the operation of the victim I located in the Dong-gu, Chungcheongnam-gu, Y, Chungcheongnam-gu, Chungcheongnam-gu, the Defendant was not aware of the victim’s goods to be stolen, and did not commit an attempted crime.
2. A special larceny: (a) around 02:30 on January 2, 2019, the Defendant: (b) destroyed a toilet window at a G convenience store managed by the victim K located in Dong-gu, Dong-gu, Chungcheongnam-gu; (c) intruded into the above convenience store by using the window at hand; (d) one cash window at a unit of 574,000 won stored in two safes of the calculation unit, and one electronic cigarette at a price of KRW 9,000,000 in total amount of KRW 20,000,000 in total; and (e) stolen it from around that time to February 2, 2019 in the same manner as the attached list of crimes, as shown in the attached Table.
