A defendant shall be punished by imprisonment for one year.
The defendant shall obtain money of 2050,000 won from B who is an applicant for compensation, and the applicant for compensation shall be C.
Reasons
Punishment of the crime
[criminal power] On September 25, 2017, the Defendant was sentenced to eight months of imprisonment for fraud at the Suwon District Court. On September 30, 2017, the execution of the sentence was terminated at the Suwon Detention House.
【Criminal Facts】
1. Fraud;
A. On October 9, 2018, the Defendant made a false contact with the victim H who became aware of at the G site before the Defendant’s house located in Kimpo-si, Kimpo-si, and the Defendant’s house located in the G site, and “if monthly wage is delayed and the money is lent, the Defendant would pay the monthly wage up to the interest at the lower rate.”
However, in fact, the Defendant did not have any money at all, and it was planned to use the money for gambling, so even if he borrowed money from the victim, the Defendant did not have any intent or ability to repay it.
The Defendant, as such, by deceiving the victim, received KRW 1,00,000 from the victim to the Defendant’s I bank account on the same day from the victim, and acquired money by transfer from November 20, 2018, totaling KRW 4,050,000 through nine times, as shown in the attached List 1.
B. On November 13, 2018, at the above Defendant’s office, the Defendant posted a notice to the J, a trading site of used goods, by accessing the Defendant’s Handphone and selling the computer to the clinic called “K”.
However, even if the defendant receives the payment from the victim, he did not have the intention or ability to sell the computer.
The Defendant, as such, by deceiving the victim, received 600,000 won from the victim, from November 21, 2018, and acquired the total amount of KRW 14,125,000 from the victims over 22 times, as shown in the attached Table 2 of Crimes List from November 21, 2018.
2. No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall issue sports promotion betting tickets or similar things to provide property or financial benefits to persons who win at the betting, and no one shall do so;
