1. The Plaintiff, Defendant Hyundai Marine Fire Insurance Co., Ltd., KRW 5,313,035, and Defendant K non-life insurance Co., Ltd.

1. Basic facts

A. In relation to the mutual aid program that entered into a mutual aid agreement with, and the Defendant Hyundai Marine Fire Insurance Co., Ltd. (hereinafter “Defendant Hyundai Sea”), the Plaintiff is the insurer who entered into a comprehensive automobile insurance contract with, the Defendant Samsung Fire Insurance Co., Ltd. (hereinafter “Defendant Hyundai Sea”) with, as to the vehicle B (hereinafter “Defendant Hyundai Sea Motor”), with respect to the vehicle C (hereinafter “Defendant Samsung F&M”), the Defendant Samsung Fire Insurance Co., Ltd. (hereinafter “Defendant Samsung F&M”) is the insurer who entered into a comprehensive automobile insurance contract with, as to the vehicle D (hereinafter “Defendant Samsung F&M”).

B. On October 7, 2015, at a point of 41.6 km (hereinafter “the instant accident site”) located in the Central Highway, Gasan-dong, Daegu-do (hereinafter “instant accident site”) where Defendant Samsung F&M was driven by Defendant Samsung F&M before October 7, 2015, due to an unforeseen accident that occurred during the operation of Defendant Samsung F&M, and at a point of 41.6 km (hereinafter “the instant accident site”), said vehicle stopped over the reverse direction, and E was seated on the driver’s seat.

다. F는 2015. 10. 7. 02:00경 피고 케이비 차량을 운전하여 이 사건 사고 장소의 2차로를 진행해 가던 중 위 사고 장소의 1, 2차로에 역방향으로 정차해 있던 피고 삼성화재 차량을 발견하고 핸들을 우측으로 급하게 틀었으나 미치지 못하고 피고 케이비 차량의 앞범퍼 부분으로 피고 삼성화재 차량의 앞범퍼 부분을 들이받은 후 다시 핸들을 좌측으로 조작하여 중앙분리대를 들이받고 1차로 상에 비상등을 켠채 정차하게 되었다
