1. [Attachment 2015 Highest 1442] Violation of the Act on Commissioned Elections by Public Organizations, etc. to Defendants

A. Defendant A was elected by going through an election for the head of the E Forestry Cooperatives Association, implemented on March 11, 2015.

선거운동은 후보자등록마감일의 다음날부터 선거일 전일까지에 한하여 할 수 있음에도 불구하고, 피고인은 선거운동기간 개시일인 2015. 2. 26.의 전날인 2015. 2. 25. 18:52경 전남 F, 2층에 있는 ‘G’ 사무실에서 휴대전화(H)를 이용하여 조합원 I에게 전화한 다음, “이번 산림조합장 선거에 출마한 A 후보입니다, 조합원님을 일일이 찾아뵙지 못해 전화를 드리니 많은 협조와 지지를 부탁합니다”라는 취지로 말하여 자신의 출마사실을 알리고 지지를 호소한 것을 비롯하여, 2015. 2. 25. 13:28경부터 같은 날 18:52경까지 별지 범죄일람표(1) 기재와 같이 총 6회에 걸쳐 조합원들에게 자신의 출마사실을 알리고 지지를 호소하였다.
