Defendant shall be punished by a fine of KRW 900,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant, as a member of the D Agricultural Cooperative (hereinafter “DF”), was “person who wishes to become a candidate” in the DF’s election of the head of the DFF on March 11, 2015.

1. Any person who violates the Agricultural Cooperatives Act shall not carry out an election campaign except by posting campaign posters, distributing election campaign bulletins, holding joint speeches or public discussions, holding support lakes and marshes using telephone and computer networks, appeal for support and distribution of name cards at public places where many people pass or gather, in connection with an election of executive officers. An election campaign can be carried out only from the day following the closing date of the election campaign to the day before the closing date of the election campaign. However, the Defendant was willing to inform the union members of the fact of his departure and distribute a letter of appeal for support prior to the election period.

On April 5, 2014, at around 15:00, the Defendant informed the Defendant of the withdrawal of the head of the association in the F office operated by himself in Nam-gu, Nam-gu, Gwangju, of the fact of the withdrawal of the head of the association, prepared a letter of the Defendant’s appeal for support by union members, and produced approximately 1,50 copies of printed materials using a reproduction machine located therein.

In addition, around April 16:35, 2014, the Defendant requested DF members of the 5-dong post office located in Nam-gu, Nam-gu, Nam-gu, Gwangju to send the above-mentioned printed materials, and around that time, sent the above printed materials to 901 members, such as H residing in No. 101-dong 907, Nam-gu, Gwangju, and then distributed 901 copies of printed materials containing the Defendant’s support, lake-dong, etc.

B. On April 9, 2014, around 16:37, the Defendant: (a) requested DF members of the 5-dong post office located in Gwangju Seo-gu to send the above-mentioned printed materials; (b) around that time, 50 printed materials were sent to 550 members of the J, etc. residing in Gwangju Seo-gu; and (c) distributed 550 copies of printed materials containing the Defendant’s supporting lake and marsh phrases, etc.

As a result, the Defendant runs an election campaign period.
