Defendants are innocent.

1. Defendant A: (a) from around November 2008 to around August 28, 2010, as the senior team leader of F Co., Ltd. (the representative director G); (b) from around September 201 to February 2, 2012, Defendant B was the senior team leader of the said company; (c) from around May 201 to around February 2013, Defendant B provided services as the senior team leader of the said company; (d) from around February 25, 2013 to around February 28, 2014; and (e) provided services as the senior team leader of the said company; (e) provided funeral services, such as the provision of funeral equipment and facilities for funeral, funeral ceremony, funeral hall selection; (e) consultation with and guidance on funeral events; and (e) provided the funeral hall and facilities for funeral and facilities for funeral promotion; and (e) provided the funeral hall and facilities for funeral, such as guidance and consultation with his/her bereaved family members; and (e) provided the funeral hall and facilities for funeral.

A. Defendant A was prohibited from receiving or receiving money or valuables in the course of performing various functions related to the funeral events, including recommendation (or selection) and introduction and mediation of a business operator who will provide a funeral counseling for bereaved family members (or a standing member). However, Defendant A’s representative J of H and I would provide 75% of sales commission (or approximately 40% of sales commission) received from the funeral facility as a result of counseling for the funeral, in return for the recommendation that he/she would be able to exclusively hold the funeral events by recommending himself/herself as a field counseling business operator for the bereaved family members who take exclusive charge of the funeral event.
