1. The Defendant: (a) KRW 21,377,837, and the Plaintiff’s KRW 20% per annum from September 4, 2015 to September 30, 2015; and (b) October 1, 2015.

The main text of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (Presidential Decree No. 26553) provides that the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings which reduces the statutory interest rate from 20% per annum to 15% per annum on September 25, 2015 is promulgated and enforced on October 1, 2015. As such, the statutory interest rate of 20% per annum until September 30, 2015 and 15% per annum from October 1, 2015 is applied (Article 2(2) of the Addenda). Accordingly, the Plaintiff’s claim that exceeds the above recognition scope is dismissed.
