1. The judgment of the first instance, including the claims modified by this court, shall be modified as follows:
The defendant is against the plaintiff.
Reasons
1. Basic facts
A. 1) The Plaintiff is a clan of its unique meaning that is a joint group of CC 18 years old-old damage D, and its current clan members are approximately 700 persons. 2) The Defendant is a similar organization of CC 25 years old-old damage F whose place of household living AM in Ansan-si is whose family members are members, and is currently four members of the clan.
B. The ownership and division relationship of each real estate listed in the separate sheet (hereinafter “each real estate of this case”) is 1) Forest E-Y 13 Y 13 Y 13 YY E prior to the partition (hereinafter “the forest of this case before the division”).
A) According to F, G, H’s original copy, and the closed copy of the register, “W” is written. However, according to the address and permanent domicile of the Plaintiff clan, and the old registration, the closed copy, and the present original copy of the register, “H” appears to be a clerical error in H. The registration of ownership was completed on April 11, 1932 due to the circumstances in the name of I, J, and K, and on April 19, 1932, with respect to respective shares in F, G, H, H, J, and K among the forest land of this case before division, the registration of ownership was completed on April 19, 1935 for each share in the name of F, H, H, J, and K on the ground of cancellation of trust on April 19, 1935; with respect to shares in I’s name, on October 5, 1953, the registration of ownership transfer was made separately by each of the “B” in the name of the Defendant’s office (hereinafter “B”).
3) After the subdivision, the instant forest land was divided and registered as the instant real estate, etc., as follows: (a) on January 8, 1987, the instant forest land was converted into the size of 11th, 2nd, 2nd, 2nd (121,190 square meters on the same day) of the Gyeonggi-gun Lian Forest land; (b) M forest 6th, 7th, 7th, 645 square meters (6,645 square meters before January 14, 1998; hereinafter referred to as “third real estate”; (c) the instant forest land was registered as the real estate listed in attached Table 3; hereinafter referred to as “third real estate”); and (d) the 7th, 1st,775 square meters of the O forest land (the real estate listed in attached Table 4; hereinafter referred to as “real estate 4”) and the real estate listed in attached Table 4 on July 24, 2013; and (d) Q 3th, 7th, 198.
