A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From March 2014 to December 31, 2015, the Defendant served as a brokerage assistant belonging to the “E Real Estate” affiliated with the Busan Seo-gu building and D located in No. 101 as a practicing licensed real estate agent.

1. The Defendant thought to prepare a real estate lease agreement in the name of D, a practicing licensed real estate agent, in the name of D, to not pay brokerage commission, etc. to D.

On November 14, 2015, the Defendant entered “F”, “G”, and “H” in the location column of the real estate lease contract form using computers in the above E-real estate office; stated the “E Licensed Real Estate Agent” in the broker column as “E Licensed Real Estate Agent” and printed out the same in the broker column, and affixed official seal on his/her name, stating the “D” as “D” and affixed official seal on the broker’s signature and seal stamp.

Accordingly, for the purpose of uttering, the Defendant forged one copy of the real estate lease contract in the name of D, which is a private document concerning rights and obligations, and exercised it as if the lessor and lessee were actually formed with no knowledge of the forgery.

B. On December 7, 2015, the Defendant stated “A building in Seo-gu Busan Metropolitan City,” “J”, “J”, and “K” as “E Licensed Real Estate Agents” in the location of the real estate lease contract form using computers at the above E-real estate office. The Defendant printed out the “E Licensed Real Estate Agents” in the broker column and printed it into the “D” and affixed official seal on the name of the broker’s signature and seal affixed thereto.

Accordingly, for the purpose of uttering, the Defendant forged one copy of the real estate lease contract in the name of D, which is a private document concerning rights and obligations, and exercised it as if the lessor and lessee were actually formed with no knowledge of the forgery.
