Punishment of the crime

The defendant is a person who has been working as a main agent of a government-funded supply contract in the area of Chungcheongbuk-do, such as a water supply and sewerage business office in the Chungcheongnam-do.

[2016 Highest 4805] On December 2008, the Defendant requested the public official in charge to permit G to enter into a supply contract for the supply contract that is ordered in the Chungcheong area because he knows many public officials while running the pipe and water tank business in the Chungcheong area.

The consent of H was obtained after proposing to the effect that “in the case of success in the contract, the contract price shall be changed by 15%.”

On July 1, 2011, the Defendant received KRW 12,611,700 from H under the pretext of receiving a contract for seven cases, including “I (the date of the conclusion of the contract: May 3, 201)” from the public official in charge, and received KRW 12,61,700 from H during the period from June 2, 201 to March 4, 2015, in total, KRW 152,381,850 in the name of receiving a contract for the supply contract of the government offices located in the region located in the Chungcheongbuk-do from June 2, 2011 to March 4, 2015, as shown in attached Table 1.

As a result, the Defendant received a total of KRW 152,381,850 on the pretext of soliciting or arranging the affairs of public officials.
