Reasons
Punishment of the crime
[2013 Highest 324] On November 30, 2012, the Defendant posted a notice stating “F,” by linking D’s residence, i.e., “E”, with the studio 2nd floor of smartphone display, which is the place of residence in Yasan-si.
The victim G made a false statement to the Defendant that “The Defendant would send 50,000 won to the Defendant after checking the deposit at the face of the transfer.”
However, even if the defendant did not have the above suspicion and received the payment from the victim, he did not have any intention or ability to sell the above suspicion.
The Defendant, by deceiving the victim as above, received 50,000 won from the victim’s agricultural bank account under the name of the Defendant.
[2013 Highest 549] On January 8, 2013, at the Defendant’s residence located H 101 Dong 1408, the Defendant made an advertisement “E” on the bulletin board, “E,” which is a trading site of used goods, and reported it to the victim I (n, 17 years old) who made the contact with the victim I (n, 10,000 won deposit of the Category 110,00 won for the Category 110,000 won for the Category 3, the Defendant made a false statement that “I will send Abech chro chro chro chro chro s.”
However, the defendant did not have the intention or ability to send the clothes as he receives the prices of the goods from the victim.
At around 19:13 of the same day, the Defendant received 110,000 won from the victim as the price for clothes from the agricultural bank account (Account Number:J) in the name of the Defendant and acquired it by fraud.
From around that time to April 5, 2013, the Defendant received a total of KRW 345,000 from the total amount of KRW 345,00 on four occasions, such as the list of crimes in attached Form.
[2013Kadan863] On February 15, 2013, the Defendant puts a letter “F” on the smartphone L bulletin board at the Defendant’s residence located in Hasan-si H 101 Dong 1408 (K apartment) around February 15, 2013, and reported it to the victim M (n, 39 years of age).
