A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall obtain money from C who is an applicant for compensation 250,000 won, and D who is an applicant for compensation.

Punishment of the crime

[2016 Highest 3192] On April 2016, the Defendant made a false statement to the effect that NAV’s Internet site “Fop-up” was “Pop-up,” and that two this model would be sent to the Defendant’s account to the victim E who reported it to the Defendant, who sent money to the Defendant.

However, even if the defendant received money from the victim without the above adial model, he did not have the intent or ability to send the above adial model to the victim.

Around May 24, 2016, the Defendant, by deceiving the victim as above, received 110,000 won from the victim via the Agricultural Cooperative Account (Account Number F) in the name of the Defendant, and acquired 3,093,000 won in total over 15 times from that time until July 1, 2016.

[2016 Highest 3523] On July 16, 2016, the Defendant posted a letter to the effect that “I will sell bicycle products” on the Internet G site, and made a false statement to the effect that “I will send money to the victim D who contacted with the above fact. I will transfer money to the door-to-door.”

However, even if the defendant did not have the above bicycle goods and receives money from the victim, he did not have the intention or ability to sell the bicycle goods to the victim.

The Defendant, by deceiving the victim as such, received 200,000 won from the victim to the account of community credit cooperatives (I) in H under the name of H in terms of the purchase price for bicycle products.

In addition, from July 12, 2016 to July 21, 2016, the Defendant received total of KRW 2,270,000 from seven occasions, such as the list of crimes in attached Table 2 from July 12, 2016, and fraudulently acquired it.
