A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a member of the reserve forces belonging to the 43 managing unit.
When submitting a medical certificate, the Defendant knew that he may postpone the training of the reserve forces, forged a medical certificate of a hospital, and submitted it to the team for the reserve forces to correct the training of the reserve forces.
1. On April 3, 2018, the Defendant forged a private document, or the uttering of the private document, at C points where the Defendant was working for the reserve forces in the military on April 3, 2018, prepared a document stating that “A” is included in the name of the patient, “A” is included in the name of the patient, “B” is included in the name of the disease, “B” is included in the diagnosis date, and “the opinion of treatment after the call” requires two-day stability,” and forged the written diagnosis by printing the above file. On the same day, the Defendant made a forged diagnosis form using the image file with the Defendant’s photograph attached Form 11, along with a written application for postponement of mobilization and education and training prepared by the Defendant and using it as a type of image file, and submitted it to the trainee in charge of the exercise of the reserve forces in the same manner as the list of crimes.
2. When a person subject to a training order under the provisions of the Reserve Forces Act is unable to comply with such order due to a disease, etc., he shall not cause the cause intentionally, nor shall he commit any false act;
On April 3, 2018, the Defendant extended the secondary supplementary training conducted at the training site of the Yangcheon-gu Reserve Forces by submitting a forged medical certificate, as described in paragraph (1), from that time to November 19, 2019, and submitted a forged medical certificate, from that time, 29 times in total, as shown in attached Table 2, until November 19, 2019.
