Reasons
Punishment of the crime
No one shall offer money, goods, or other economic benefits to a candidate or a person who intends to become a candidate, or to a meeting or event of an institution, organization, facility, or electorate, in connection with an election, and in such cases, making contributions by disclosing the name of the candidate or the political party to which he/she belongs or in the manner as presumed that the candidate or the political party to which he/she belongs makes a contribution, shall be considered as a contribution act for the candidate or political party in connection with the election.
Defendant
B, the assistant officer of the National Assembly member D who wishes to be a candidate by going to the C constituency at the 20th National Assembly general election of April 13, 2016 and going to the C constituency at the 21st National Assembly general election of 2020 and going to the said constituency at the 21st National Assembly member election of 2020 (Grade V), from August 2017 to November 2017, and the assistant officer (Grade IV) from November 2017 to December 2018, who takes charge of the management of the E regional constituency, and the defendant A is the head of the E-Gun branch of the F organization E branch.

A around January 12, 2018, at the information council of the members of the D Council held at the H association located in Jeonnam-nam G, the purpose of Defendant B was to request the D Council to support the activities of the constituency area on the side of the D Council members and to provide support related to the affairs of the F organization in the future. Defendant B stated, “I would like to provide the elderly facilities, such as the E community senior citizens center, in consideration of the degree of KRW 5 million from the I Association funds, and to inform the place of support.”
Accordingly, Defendant B consented to the above proposal for the management of the E constituency of the members of the D Council, and around February 2018, notified Defendant A of the amount of support for 20 facilities, including the Senior Citizens Association, located in the E-Gun, and each facility. Defendant A, around March 3, 2018, was prepared to deliver goods equivalent to the amount of support for the above 20 facilities to the J and became known to Defendant B.
around that time, Defendant B was 20 facilities.
