A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.

However, for two years from the date this judgment becomes final and conclusive.

B around March 17, 2017, upon entering into a lease agreement with C on the second floor of the Daegu North-gu D building owned by C with the said amounting to KRW 20 million, and the said F succeeded to the said lease agreement by transferring the PC operation right from the second floor of the said building to F while operating the EPC on the second floor of the said building. On July 26, 2017, the said F entered into a lease agreement with C and the said deposit amounting to KRW 20 million on the second floor of the said building.

On the other hand, the defendant A acquired the above PC operation right from the above F on August 2018, but did not enter into the lease contract with the above C on a regular basis.

Defendant

A was to obtain a loan from a financial institution due to the shortage of funds to operate the above PC bank, but it was intended to obtain a loan in the name of Defendant B, a dong-in relationship with the second floor of the above building, with a high credit rating due to the lack of credit rating. Defendant B still maintained a lease contract for the second floor of the above building, and Defendant B forged the lease contract as if the above C had a claim to receive a refund of KRW 20 million from the above PC, and submitted it to the financial institution.

On August 3, 2018, Defendant A forged Private Document: (a) at the PC bank above; (b) around August 3, 2018, using a computer, read “M”, “Seoul Metropolitan City North-gu G; (c) the part to be leased; (d) the term “two stories” in the deposit column; (e) the term “one hundred million won in the rent column”; (e) the lessor’s address column; (b) the lessor’s address column; (c) the lessor’s resident registration number column; (d) the lessor’s name column; and (e) the lessee’s address column as “C”; (e) the lessee’s resident registration number column as “M”; and (e) the lessee’s resident registration number column as “M”; and (e) the lessee’s name column as “BB”; and (e) the Defendant’s name and seal attached to the name of the said C at his discretion; and (e) the lessee’s name and seal attached to B.
