Defendant shall be punished by a fine of KRW 1,000,000.

If the defendant does not pay the above fine, 50,000 won shall be paid.

Punishment of the crime

On the basis of the fact that C keeps four copies of the loan certificate issued to D, the Defendant had the intent to bring a lawsuit against C over a loan claim using the above loan certificate.

1. Alteration of any private document;

가. 피고인은 2008. 11. 초경 서울 서초구 E아파트 F에 있는 피고인 운영의 G 사무실에서, 미리 D로부터 건네받아 보관하고 있던, “차용증, 일금 오천만원정(50,000,000), 상기 금액을 정히 차용함, 차용기간: 2006년 2월 20일, 2005년 11월 20일, 차용인: C(H) 서초구 I빌라 12차 201호”라고 기재되어 있는 C 명의 차용증의 하단에 친구인 J로 하여금 검정색 볼펜을 이용하여 “A 貴下”라고 기재하게 하였다.

Accordingly, for the purpose of uttering, the defendant altered one copy of the loan certificate in C, which is a private document related to rights and obligations.

B. The Defendant:

At the same time and place as in Paragraph C, which was kept in custody with D, stated “A” on April 10, 2006 at the bottom of the certificate of borrowing in the name of C, stating “A”, “A”, “B”, “C,” written at the bottom of the certificate of borrowing in the name of D, “B,” “I” (80,000,000), and “C,” written at the same time and place as in this paragraph.

Accordingly, for the purpose of uttering, the Defendant altered one copy of a private document C, which is a private document related to rights and obligations.
