Reasons
Summary of Facts charged
1. Around May 25, 2012, the fraud Defendant made a false statement to the effect that “D” office located on the eightth floor of the Gangdong-gu Seoul Metropolitan Government Building, “F was completely prepared for the formation of the F, and the victim E shall be paid KRW 30 million with the preparatory fund for the formation of the political party, as the joint representative of the G Convention would create F in the G Convention.”
However, even if the defendant received KRW 30 million from the victim, he did not have any intention or ability to prepare for the formation of the FF, or to use it.
Nevertheless, the Defendant, by deceiving the victim as above, was given KRW 30 million for the formation of the political party by the victim.
2. The Defendant, while borrowing money from other persons and without obtaining consent from E, thought that the name of the letter of agreement or the letter of loan was written in preparation for E.
On June 19, 2012, the Defendant, at the “D” office located on the eightth floor of the Gangdong-gu Seoul Metropolitan Government C building, sealed the E seal affixed by the Defendant in advance on the name of the Defendant, and delivered I a false agreement to be duly formed, as above, with the Defendant’s instructions, on the loan certificate written by “D” office with a black-type pen (130,000,000 (10 million won) and with a fixed amount borrowed and repaid 260,000,000 (260,000) on July 19, 19, which is after the month, and one month until August 19, 2012.”
Accordingly, for the purpose of uttering, the Defendant forged and exercised a copy of the borrowed certificate in the name of E, a private document related to rights and obligations.
B. On June 19, 2012, the Defendant, at the “D” office located on the eightth floor of the Gangdong-gu Seoul Metropolitan Government Cbuilding, borrowed from the Defendant’s instruction, the amount as above, Had’s Had’s Had’s Kad’s No. A4 using a test color pen: 20,000,000 won (hereinafter “0,000 won”).
